We are not liable for the misuse of systems or websites we build for clients, or for any issues arising from the misuse of sensitive information provided by clients, provided we can prove our due diligence in storing this data responsibly by following modern devOps standards and using appropriate data-storing tools. We are also not responsible for any misuse or further development of the websites or systems we create after the end of our contract.

6. Limitation of Liability

Web Dev by Krissy is not liable for any misuse of the websites or systems we create by the clients who own the websites, third-party agents, or end users, during the time of our business relationship or afterward. We are not liable for any lack of compliance by anyone other than ourselves regarding the misuse of sensitive or private information from our clients or their end users. Additionally, Web Dev by Krissy is not liable for any further development, modification, or misuse of the websites or systems we create once our contract with the client has ended and all applicable business obligations have been fulfilled.

7. Governing Law

These Terms and any disputes related to them shall be governed by and construed in accordance with the laws of the United States, including the California Consumer Protection Act, or any other jurisdiction where Web Dev by Krissy may be operating at the time. For our clients, the applicable legal jurisdiction will be based on their location, or as otherwise agreed upon in the contract.

8. Termination Clause

Web Dev by Krissy reserves the right to terminate any contract or ongoing services with a client at our discretion. This may occur for reasons including, but not limited to: lack of necessary collaboration required from the client to effectively deliver our services or product; misuse of the product or services provided by Web Dev by Krissy; or if the client or potential client provides false information to us or any third-party services or collaborators involved in delivering the requested product or services.

9. Refund Policy

Refunds are applicable only to retainer contracts. If a contract that includes 20 hours or more of pre-paid time is terminated early under agreeable circumstances by both parties—including but not limited to the completion of the requested product or service, or unforeseen economic difficulties for the client—the client is entitled to a refund of the outstanding hours in the contract. However, an early termination fee equivalent to 20 development hours will be deducted from the refundable amount.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after the posting of changes constitutes your acceptance of the revised Terms. Please review these Terms periodically to stay informed of any updates.
